פסיקה פרוצדורלית בארה"ב: סביר יותר שהנשיא טראמפ קשר קשר וניסה להפריע

 פסיקת ה-UNITED STATES DISTRICT COURT )CENTRAL DISTRICT OF CALIFORNIA SOUTHERN DIVISION ) בעניין אי-הטלת חסיון על מסמכים מסויימים בהקשרי להתקפה על הקפיטול ב-6 בינואר 2020 היא אירוע מבשר-רעות עבור דונאלד טראמפ. עניין Eastman vs. Thompson and others (Case No. 8:22-cv-00099-DOC-DFM) (PDF) הוא ככל הנראה הפעם הראשונה שבה קבעה רשות משפטית בארה"ב שסביר יותר שטראמפ

"corruptly attempted to obstruct the Joint Session of Congress on January 6, 2021. " 

ושטראמפ גם - 

" conspired toobstruct the Joint Session of Congress"

 

ובציטוטים מלאים יותר מההכרעה המשפטית האמורה: 

"Based on the evidence, the Court finds it more likely than not that President Trump corruptly attempted to obstruct the Joint Session of Congress on January 6, 2021. " 

(עמ' 31 החל מהכותרת Obstruction of an official proceeding ועד עמוד 36 )

"Based on the evidence, the Court finds that it is more likely than not that President Trump and Dr. Eastman dishonestly conspired to obstruct the Joint Session of Congress on January 6, 2021. "

(עמוד 36 החל מהכותרת Conspiracy to defraud the United States ועד עמוד 40 ) . 

עם זאת, יש לציין כי לגבי Common Law Fraud נקבע: 

"As the Court discusses below,264 review of the eleven remaining documents reveals that none further efforts to spread false claims of election fraud. Accordingly, the Court does not reach whether President Trump likely engaged in common law fraud. " (עמוד 40, תחת הכותרת  Common Law Fraud)

ולכן כן הוטל חסיון על 10 מתוך 11 מסמכים בהקשר הזה.

אבל במסגרת הקביעה הזו, המסמך ה-11 לא נכלל בחסיון מאחר וכלשון ביהמ"ש: 

Because the memo likely furthered the crimes of obstruction of an official proceeding and conspiracy to defraud the United States, it is subject to the crime-fraud exception and the Court ORDERS it to be disclosed. (כמפורט בעמ' 40-41 )

העובדה ש-101 מסמכים שטראמפ ואח' נאבקו נגד מסירתם ל-The Jan. 6 select committee in Congress  כנראה יגיעו עכשיו לידי הועדה (בכפוף לאפשרות הליכי ערעור נוספים), מבשרת שלב נוסף בתהליך שבו הולכת ומתקרבת ההכרעה בשאלה - האם ארה"ב עתידה להעמיד את דונאלד טראמפ לדין על נסיון לחבל בהליך הדמוקרטי של ארה"ב? או שמא ההקצנה של יחסי דמוקרטים-רפובליקאים בארה"ב תביא לכך שהשאלה מה בדיוק קרה בבית הלבן ועד כמה היה מעורב ממשל טראמפ בהתקפה על הקפיטול תישאר שאלה של השקפה פוליטית?
